The Company helps psychologists and other mental health providers (collectively, “Providers”) learn more about their clients (“Clients”) in an efficient manner by providing AI-assisted psychoeducational reports through our services. Specifically, the Company provides services through the Website, including AI-assisted psychoeducational report writing that offers tailored, professional-grade reports with expert recommendations, suspected disability insights, personalized action plans, and accommodations (collectively, “Services”). Unless otherwise stated in this Policy, references to the “Website” include the Services and the Website.

We respect the privacy of all visitors of the Website and users of the Company’s Services and are committed to protecting privacy through our compliance with applicable law and this Policy. We understand that Personal Information (defined below) and Protected Health Information (defined below) are private, and we are dedicated to preserving the confidentiality and integrity of such information.

  • Information by which you (or your Client) may be personally identified, such as name, postal address, email address, telephone number, social security number, or any other identifier by which you (or your Client) may be contacted online or offline (“Personal Information”);
  • Personal Information regulated under applicable law, such as the Health Insurance Portability and Accountability Act (“HIPAA”) or an equivalent state law governing the use or disclosure of health information, including Protected Health Information (as defined by HIPAA) that Clients provide to Providers, that is in turn shared with the Company (“Protected Health Information”);
  • Information that is about your Client but individually does not identify your Client;
  • Information that is about you but individually does not identify you; and/or
  • Information about your internet connection, the equipment you use to access the Website, and usage details.

Information Provided to Us

We collect Personal Information about you or your Client when you provide it to us. This includes Personal Information that you provide by filling in forms on the Website, as well as Personal Information provided at the time of registering to use the Website and subscribing to our Services.

We also collect information that is about you, and that may include Personal Information about you, when you provide it to us. This may include, without limitation, any feedback that you provide to us on or through the Website or otherwise regarding our Services, the Website, and the psychoeducational assessments that we produce in connection with our Services (collectively, “Feedback”).

We also collect Personal Information, including Protected Health Information, about Clients when their Providers provide it to us on or through the Website. This includes Personal Information and Protected Health Information contained in any tests, school evaluations, report cards, intake forms, medical records, and similar documents and information that Providers submit on or through the Website in connection with our Services (collectively “Documentation”). Any Protected Health Information that Clients provide to Providers, that is in turn shared with the Company, will be safeguarded and processed in accordance with any applicable Business Associate Agreement.

By providing us with Personal Information (whether of yourself, a Client, or a third party), you represent and warrant that you have obtained all requisite consent and authorization required under law to share Personal Information, including Protected Health Information, with the Company. The Company shall not be responsible for your failure to obtain lawful authorization to disclose Personal Information, including Protected Heath Information, with the Company.

In addition, you represent and warrant that all Personal Information (including Protected Health Information) shared with the Company is accurate and complete. The Company shall not be responsible for the Company’s Services based on inaccurate or unreliable information.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with the Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.

How We Use Your Information

Information Pertaining to Clients and Our Services

Except as described in this Policy or in our Terms of Service, the Documentation, Personal Information, and Protected Health Information pertaining to Clients that Providers provide to us on or through the Website or otherwise in connection with our Services will be kept confidential and used or disclosed only to the extent minimally necessary to support our Services. We use Documentation and Client Data (defined below) to provide the Services.

We employ advanced referential tokenization techniques to protect sensitive information that Providers submit on or through the Website pertaining to their Clients, including Personal Information, Protected Health Information, and other information contained in Documentation (collectively, “Client Data”). This approach ensures that Client Data is preserved through consistent tokens while safeguarding Personal Information and Protected Health Information.

All Client Data is securely encrypted at rest and in transit using AWS Key Management Service in Amazon S3, under the protection of our Business Associate Agreement with AWS. Our tokenization process is designed to exceed the requirements of HIPAA and FERPA, minimizing the likelihood of any unprotected data.

Once we tokenize Client Data into de-identified and anonymous form so that such Client Data no longer includes any Personal Information, Protected Health Information, or information that can identify Clients or reasonably be used to identify Clients (“Tokenized Data”), we use the Tokenized Data for our analytical and other business purposes, including, without limitation, to train our current and future AI models in perpetuity.

We use information that we collect about you or that you provide to us, including any Personal Information about yourself:

  • To present the Website and its contents to you.
  • To present and facilitate the Company’s Services to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account or subscription, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We may disclose your Personal Information that we collect or you provide as described in this Policy:
